Terms Of Service

Effective Date: 2026-07-14

Version: 1.1

Operator: Mirakuru Europa OÜ (registration number 14564077), Sepapaja 6, Tallinn 15551, Estonia.

1. Introduction And Acceptance

These Terms of Service ("Terms") govern your use of PuchiDen (プチ電), a browser-based international calling service operated by Mirakuru Europa OÜ ("we", "us", "our"). By creating an account or using the service you agree to be bound by these Terms. If you do not agree, please do not use the service.

Development and user support are provided to Mirakuru Europa by 株式会社Kafkai Giken (Kafkai Giken, Inc., Japan) under a written Data Processing Agreement. Kafkai Giken acts as a sub-processor on our behalf.

2. Definitions

  • Service — the PuchiDen website at puchiden.app and the browser-based calling functionality it provides.
  • Credits — prepaid units denominated in EUR that you purchase in advance and that we deduct from your balance when you place calls.
  • Call Records — metadata we retain for each connected call (destination number, caller ID used, start time, duration, per-minute rate, cost), described in our Privacy Policy.
  • Verified Caller ID — a phone number you have confirmed you control and that you may select as the number shown to the person you call.
  • Sub-processor — a third-party provider we engage to deliver part of the service, as listed in our Privacy Policy.
  • You — the individual who has registered an account or otherwise uses the service.

3. Service Description

PuchiDen is a browser-based international calling service. From your web browser you can place calls to phone numbers in the countries listed on our rates page, without installing an app or inserting a SIM card.

By default, the number shown to the person you call is a PuchiDen number; your personal mobile number is not revealed. You may also verify phone numbers you own and select them as your outbound Caller ID.

Your voice is carried over the internet from your browser to a telecommunications infrastructure provider, which bridges the call to the public telephone network. We do not record, transcribe, or analyse call audio (see §12 and our Privacy Policy).

4. Eligibility

To use PuchiDen you must:

  1. Be at least 18 years old and legally competent to enter into a contract;
  2. Not reside in, or place calls to, a country or person subject to a comprehensive sanctions regime imposed by the European Union, the United States, or the United Nations;
  3. Not be barred from using the service under any previous action we have taken against you.

By creating an account you confirm that you meet these requirements.

5. Account Registration

  1. You register with an email address only. We do not collect your phone number, your real name (an optional display name only), your address (except if you later provide a billing profile for invoices), or any social-login credentials.
  2. You are responsible for maintaining the confidentiality of your account, including your email address and the access codes we send you.
  3. One Account Per Person. Creating multiple accounts to abuse free-trial credits, to evade a suspension, or for any similar purpose will result in termination of all affected accounts and forfeiture of the credits in them.
  4. Notify us immediately if you believe your account has been compromised.

6. Credits And Payments

  1. PuchiDen operates on a prepaid credit system denominated in EUR. You purchase credits in advance and we deduct the cost of each call from your balance.
  2. Minimum Purchase: The minimum amounts for manual top-up and automatic top-up are shown on our top-up page and may change from time to time.
  3. Payment Methods. Card payments are processed by Stripe. We never receive or store your full card details — they are entered directly into Stripe's secure form. Cryptocurrency payments are processed by NOWPayments on its hosted payment page. We never receive or store your wallet address or private keys. Credits from a cryptocurrency purchase are added to your balance after the payment is confirmed on the blockchain — usually within minutes, but it can take longer. If you pay less than the invoiced amount, your balance is not credited automatically; contact support and we will resolve it manually.
  4. Credit Dormancy. Credits do not expire on a fixed calendar date, but if you do not place a call or purchase a top-up for 6 consecutive months, your remaining credits will be marked as inactive. Inactive credits can be reactivated at any time, automatically, by placing a call or purchasing a top-up — no request is needed. If credits remain inactive for a further 12 months (that is, 18 months in total with no call or top-up), and you do not respond to a reminder email we send at least 30 days before the forfeiture date, the remaining balance will be forfeited. This rule exists to let us close out genuinely abandoned balances; for active users it has no effect.
  5. Credits are non-transferable, non-assignable, and not resellable. You may not share credits between accounts, sell, lend, or donate them, or use them as security for any obligation.
  6. Automatic Top-Up. You may enable automatic top-up so that we charge your saved payment method when your balance falls below a threshold you set. Automatic top-up is available for card payments only. You may disable it at any time from your account settings. It disables itself automatically after three consecutive payment failures.
  7. Taxes. Our prices are shown without VAT. If you live in the European Union, VAT at the rate that applies to you is added at checkout and shown before you pay. Customers outside the European Union are not charged EU VAT. The credits you receive are the same either way. We use the billing country you give us to decide whether VAT applies, so please keep it accurate. Any tax that your own country may charge on this service is your responsibility. Because of local tax rules, we do not sell credits to customers in certain billing countries. The top-up page tells you if this applies to you. If a payment from such a country still reaches us, we refund it in full and add no credits.

7. Pricing And Call Billing

  1. Calls are billed per minute, with a minimum charge of one minute for any connected call, even if the call lasts less than a minute.
  2. Calls that do not connect (busy, no answer, failed) are free.
  3. Current per-minute rates for each destination are published on our pricing page. The rate that applies to a call is the rate published at the moment the call starts.
  4. We may change rates at any time. Rate changes are not retroactive: calls already in progress when a rate changes continue at the rate at which they started.

8. Right Of Withdrawal And Refunds

8.1 Statutory Right Of Withdrawal (EU/EEA Consumers). If you are a consumer resident in the European Union or European Economic Area, you have the right to withdraw from this contract within 14 days of your credit purchase, without giving any reason, under Directive 2011/83/EU and the Estonian Consumer Protection Act. To exercise this right, contact us from your registered email address. We will refund the unused portion of your credits to the original payment method within 14 days of receiving your notice.

8.1.1 How We Determine EU/EEA Residency. Because we do not collect your country at registration, we determine eligibility for §8.1 using the following signals, in order of priority:

  • (a) the country on your billing profile, if you have set one;
  • (b) the country of the payment instrument (card issuer country, as reported by our payment provider) used for the purchase in question;
  • (c) your own declaration in the refund request.

If none of (a) or (b) identifies an EU/EEA country, we will apply the statutory right if you state in your refund request that you reside in the EU/EEA. We will only ask for documentary evidence of residency (for example, a recent utility bill or government-issued identification) if signals (a) and (b) clearly indicate a non-EU/EEA country and we have a reasonable basis to doubt your declaration.

8.2 48-Hour Hassle-Free Full Refund. Regardless of where you live, if you request a refund within 48 hours of your purchase and you have not used any of the credits from that purchase, we will issue a full refund to the original payment method with no processing fee.

8.3 Refunds Beyond The Above Windows. After the 48-hour window (and, for EU/EEA consumers, after the 14-day statutory window), we offer refunds of unused credits on the following terms:

  • The remaining unused balance must be greater than EUR 10. Balances of EUR 10 or less are not refundable.
  • A flat processing fee of EUR 5 is deducted from each refund.
  • Only unused credits are refundable. Credits already consumed by completed calls are not.

8.4 How To Request A Refund. Email us from the email address associated with your account, stating the purchase date, the amount you are requesting, and the payment method used. We will reply within three business days.

8.5 Refunds On Account Termination. If we terminate or suspend your account for a breach of these Terms (see §15), your remaining credits may be forfeited. If we terminate your account without a breach on your side — for example, because we discontinue the service — we will refund your unused credits in full, without the EUR 10 minimum or the EUR 5 fee.

8.6 Refunds Of Cryptocurrency Purchases. If your purchase was paid in cryptocurrency (via NOWPayments), the refund rules above apply with the following adjustments. Refund amounts are calculated in EUR, based on the EUR value of your original purchase, and are sent in cryptocurrency through our payment processor to a wallet address that you designate in your refund request; because we never store your wallet address, we cannot issue a cryptocurrency refund until you provide one. For cryptocurrency purchases, this process is what "the original payment method" in §8.1 and §8.2 refers to. Because cryptocurrency exchange rates fluctuate, the amount of cryptocurrency you receive may differ from the amount you originally paid. Blockchain network fees may be deducted from the refund; these are network costs, not a processing fee charged by us, and they apply independently of the fee rules in §8.2 and §8.3.

9. Acceptable Use And Prohibited Activities

You agree not to use the service, and not to attempt or assist others to use the service, for any of the following:

  1. Harassment, threats, hate speech, or content that is illegal in any applicable jurisdiction;
  2. Spam calling, robocalling, automated dialling, wardialling, or otherwise placing calls in a manner that is unsolicited or automated;
  3. Toll Fraud, International Revenue Share Fraud (IRSF), Or Premium-Rate Abuse — any scheme that seeks to generate revenue from artificially inflated traffic to premium or high-cost destinations;
  4. Caller-ID Spoofing — selecting as your outbound Caller ID any number you do not own or do not have the explicit permission of the owner to use;
  5. Impersonation of any person or entity, phishing, social engineering, or fraud of any kind;
  6. Placing calls that violate the laws of the country where the call originates or terminates, including prohibitions on unsolicited marketing calls (such as the EU ePrivacy Directive, the US Telephone Consumer Protection Act, or equivalent laws elsewhere);
  7. Reverse-engineering, decompiling, scraping, or attempting to derive the source of any part of the service; probing or circumventing its security; or placing a volume of requests designed to degrade the service for other users;
  8. Using the service in any jurisdiction where doing so is unlawful;
  9. Sharing your account credentials with another person, operating the service as a shared resource, or reselling credits or call minutes.

We reserve the right to investigate any suspected breach of this section and to take appropriate action, including immediate suspension or termination under §15.

10. Caller-ID Verification

When you verify a phone number for use as your outbound Caller ID, you represent that you own that number or have the owner's explicit permission to use it. Using a Verified Caller ID for a number you do not legitimately control is a serious breach of these Terms and will result in immediate termination.

11. Emergency Services — Important Notice

PuchiDen does not provide access to emergency services (such as 112 in the EU, 110 or 119 in Japan, 911 in the United States, or equivalent numbers elsewhere). Do not use PuchiDen to call emergency services. Keep a mobile phone or landline with active emergency-calling capability available for emergencies.

12. Privacy And Data Protection

The personal data we hold about you and how we use it is described in our Privacy Policy. Key points to note in connection with these Terms:

  1. Call Records are retained for 60 days and are then automatically deleted.
  2. Financial transaction records (credit purchases) are retained for 7 years to comply with Estonian tax law.
  3. Unless explicitly requested by you, we do not record, transcribe, or analyse call audio.

13. Intellectual Property

All intellectual-property rights in the PuchiDen service (including the PuchiDen and プチ電 marks, the user interface, the software, and the content of the site) belong to Mirakuru Europa OÜ or its licensors. Nothing in these Terms grants you any right in those properties except a limited, non-exclusive, non-transferable licence to use the service in accordance with these Terms.

14. Service Availability

We aim to provide a reliable service but we do not guarantee uninterrupted availability. We may modify, suspend, or perform maintenance on the service with or without notice. We are not liable for events beyond our reasonable control, including failures of the public internet, of the public telephone network, or of our infrastructure sub-processors.

14.1 Nature Of VoIP Service. You acknowledge that calls are carried over the public internet and terminate on the public telephone network. Without limiting §17, please note the following characteristics:

  • audio quality, latency, and call continuity depend on your internet connection, the terminating carrier, and other networks we do not control;
  • some destinations or numbers may be unreachable due to carrier filtering, routing changes, or regulatory restrictions;
  • caller ID information we transmit may be altered, replaced, or stripped by terminating carriers as a normal anti-spoofing measure, and may not display on the recipient's device as you selected;
  • call-completion rates are not guaranteed.

We will refund credits deducted for a call that was billed in error, but we are not otherwise liable for these characteristics of the underlying networks.

15. Suspension And Termination

15.1 Grounds For Suspension Or Termination By Us. We may suspend or terminate your account, with or without notice, if:

  1. We reasonably believe you have breached these Terms, including §9 (prohibited activities) or §10 (Caller-ID verification);
  2. We reasonably suspect fraud, payment-instrument abuse, or the use of your account by a third party without your authorisation;
  3. A payment is reversed or charged back and you do not resolve the matter within 30 days of our notice;
  4. You do not log in or use the service for a continuous period of 12 months (dormant account);
  5. We are required to do so by applicable law or by a valid order from a competent authority.

15.2 Termination By You. You may close your account at any time from your account settings or by contacting [email protected]. On closure we will delete your personal data in accordance with our Privacy Policy, subject to the 7-year retention required by Estonian tax law for financial records.

15.3 Effect On Credits. If we terminate your account for cause (breach of these Terms), remaining credits may be forfeited. If we terminate your account without cause — for example, because we discontinue the service — we will refund your unused credits in full, without the EUR 10 minimum or EUR 5 fee described in §8.

16. Changes To The Service And These Terms

We may change the service and these Terms from time to time. We will notify registered users by email at least 30 days before any material change to these Terms takes effect. The effective date and version at the top of this document always reflect the current version.

If you do not agree with a proposed change, you may close your account and request a refund of your unused credits before the change takes effect. In that case the EUR 10 minimum and EUR 5 fee described in §8.3 are waived.

17. Warranty Disclaimer

Except as required by mandatory consumer-protection law that applies to you, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in this section limits warranties or rights that cannot be excluded or limited under the law applicable to you as a consumer.

18. Limitation Of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages;
  • Our total aggregate liability to you for any claim arising out of or in connection with the service is limited to the amount you have paid us in the 6 months preceding the event giving rise to the claim.

Nothing in this section excludes or limits our liability for fraud, for intentional misconduct, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under the law applicable to you as a consumer. If you are a consumer resident in the EU/EEA, the mandatory consumer-protection rules of your country of residence continue to apply and are not reduced by these Terms.

19. Indemnification

You agree to indemnify and hold us harmless against any third-party claims, damages, losses, and costs (including reasonable legal fees) arising out of your use of the service in breach of these Terms, in particular breach of §9 (prohibited activities). This section does not apply to the extent that the loss was caused by our own breach of these Terms or our own unlawful conduct, nor to the extent that limiting such a claim against you would be contrary to mandatory consumer-protection rules that apply to you.

20. Governing Law And Jurisdiction

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws rules.

  1. If you are a consumer resident in the European Union or European Economic Area, the mandatory consumer-protection rules of your country of residence continue to apply, and you may bring proceedings in the competent courts of your country of residence (Regulation (EU) No 1215/2012, Article 18).
  2. For any other dispute, the courts of Tallinn, Estonia have exclusive jurisdiction.

EU consumers also have access to the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

21. Language

These Terms are provided in English and Japanese. The English version is the authoritative one. If there is any inconsistency between the two, the English version prevails.

21.1 Language Of Communications. All formal communications between you and us relating to these Terms — including refund requests, account-change requests, legal notices, and breach notifications — shall be conducted in English. This does not affect your rights before any court that has jurisdiction over a dispute.

22. Miscellaneous

  1. Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.
  2. No Waiver. Our failure to enforce any right under these Terms is not a waiver of that right.
  3. Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to an affiliate or to a successor in connection with a merger, acquisition, or reorganisation; where required by law we will give you notice.
  4. Entire Agreement. These Terms, together with the Privacy Policy, the Transparency page, and any checkout-level notices shown to you when you purchase credits, constitute the entire agreement between you and us regarding the service and supersede any prior agreement on the same subject.
  5. Notices. We may give you notice under these Terms by email to the address registered with us or by posting a prominent notice on our website. You may give us notice by email to the email address as written in "Contact" below.
